MResearch and Suggestions incorporated in the report of Constitutional Review Committee

We have contributed in the drafting and conclusion of the Constitution Review Committee Report in the years 2001-02. The committee was constituted after 50 years of adoption of the Constitution by the republic of India and the report paved the way for quite a few Constitutional and other legislative reforms.

Collaboration with Financial Times, dedicated to FDI’s in India

We have acted as a reliable bridge as between India and Global Business Community by advising the investments in the Special Economic Zones (SEZ’s), Software Technology Parks (STP’s), Investment Corridors, counselling through the Invertor Meets and representing the Invertor interests before the Government Authorities and the Sovereign Courts in India. Advised towards the framing of Policy by the Government of India relating to the IT Parks

There’s no price for guessing that IT sector, is the biggest foreign exchange earner in the Indian economy, other than providing job opportunities to millions of IT professionals. The coming up of dedicated IT parks in India has proved a boon for the growth of the IT sector in India.

Setting up of Draft Inquiry Committee by the State of Punjab

Setting up of Draft Inquiry Committee by the State of Punjab in 2016 to enquire into the irregularities in the implementation of DL/RC Contact and ADTT Contract by M/s Smart Chip in partnership with the Transport Department: SUO wrote to the CM and Principal Secretary regarding the issue relating to perpetration of corruption, violation of laws of competition and government procurement between Smart-Chip Pvt. Ltd. and unknow transport officials in the Transport Department.

SUO gave representations to the State of Uttar Pradesh

In 2017, SUO gave representations to the State of Uttar Pradesh, regarding the arbitrary compulsory charge of meal charges by the private schools, even when the same was not being consumed by the students. The State of Uttar Pradesh directed the Directorate of Education to inquire into the said matter. Later on, CBSE issued directions to all the affiliated schools to refrain from imposing such charges.

SUO gave a representation and personal hearing to the Radhakrishnan Committee

SUO gave a representation and personal hearing to the Radhakrishnan Committee in April, 2017, which was formulated by the Hon’ble Supreme Court for consideration of issues relating to road safety and give directions for road safety measures. The Radhakrishnan Committee issued directions to States/UTs based on the representation of SUO for effective implementation of the Speed Governor Policy, which has furthermore been adopted by various States/UTs.

Hon’ble Bombay High Court, in 2018, required SUO to give policy outline to the Transport Department of Maharashtra relating to effective implementation of Speed Limiting Devices

Litigation Related Impact

Vyapam Scam

In the matter of Vyapam Scam, SUO secured bail from the Hon’ble Supreme Court for certain innocent doctors who allegedly got involved in the said scam

HSRP manufacturer

In 2015, SUO got the CBI reference given by the Hon’ble Allahabad High Court against a HSRP manufacturer set aside before the Hon’ble Supreme Court

Oppression & mismanagement by the shareholders

Rights of shareholders

In 2018, Electoral Bonds matter before the Hon’ble Supreme Court, SUO raised the issue relating to the rights of the shareholders of the Companies making anonymous donations and the issue relating to passing it as the Finance Bill

Relief for home buyers in the PACL matter

In 2020, secured relief for home buyers in the PACL matter, where for violation of SEBI norms by PACL, SEBI was made custodian of all its properties and assets was required to dispose it off through the Lodha Committee formed for the said purposes. However, issues were raised with respect to those properties of PACL wherein, third party rights of the home buyers have been created and thus, could neither be disposed or nor developed any further.

SUO represented before the Court on behalf of the home-buyers for seeking specific directions from the Hon’ble Court for development of such plots which were to be developed by PACL.

The Hon’ble Court directed GMADA to ascertain the amount of money required for development and required all the home buyers to give details regarding the unsold inventory and the remaining money left to be paid from the plot holders.

Secured relief for Clients in Service Law related matter against arbitrary termination, arbitrary reduction of pay, arbitrary non-recruitment and promotion

IP Prosecution

Successfully defended the IP Prosecution against M/s Taj, relating to the usage of the trademark of “TAJ TOWERS”

Mandatory Implementation of HSRPs in various States/UTs

Mandatory Implementation of HSRPs in various States/UTs on the basis of the law laid down by the Hon’ble Supreme Court which represented by SUO: In 2016, Suren Uppal represented on behalf of the Petitioner before the Hon’ble Supreme Court in a contempt petition against the States/UTs and certain implementing agencies for violation of the Rule 50 of Central Motor Vehicles Rules governing HSRP.

In the said matter, the Hon’ble Supreme Court laid down specific guidelines relating to effective implementation of High Security Registration Plates to ensure security and transparency in the system.

Effective implementation of Rule 118 of Central Motor Vehicles Rules

From 2015 onwards, SUO spearheaded the matter relating to effective implementation of Rule 118 of Central Motor Vehicles Rules before the Hon’ble Supreme Court and various High Courts: The Hon’ble Supreme Court issued notices to the Central Government and all the States/UTs for seeking their responses relating to the status of implementation of the rule relating to mandatory affixation of Speed Limiting Devices in Transport Vehicles

In 2017, SUO defended the empanelment notifications for affixation of Speed Governors of various State Governments which was challenged by certain manufacturers of Speed Governor manufacturers.

The Hon’ble High Court of Punjab & Haryana upheld the powers of the State Government to empanel the manufacturers for implementation of Rule relating to mandatory affixation of Speed Governors

In 2017-18, SUO defended the successful bidder in the matter of implementation of HSRP against the arbitrary claim of the unsuccessful bidder challenging the tender evaluation committee’s decision

In 2018, SUO successfully defended challenged the illegal tender of the Transport Department of Goa for the implementation of Rule 125(H) of Central Motor Vehicles Rules for mandatory affixation of Vehicle Tracking Devices as the same was in contravention of the Rule 125(H) of CMVR, constitutional principles and the BIS norms

Frivolous PIL

In 2019, SUO successfully defended against the frivolous PIL on behalf of the successful empanelled manufacturer and the State and Testing Agency filed before the Hon’ble High Court of Bombay, at Goa for alleged non-compliance with BIS amended standard.

In 2017, SUO secured order for reimbursement of Service Tax from the State Government in the project for implementation of Smart Card based Vehicle Registration Certificate for the period for which the contractor M/s Shonkh was not legally mandated to pay the Tax Commissioner.

We ensured the launch of 4 strike motor bikes by TVS in India, which had become a bone of contention as between TVS Suzuki. The result has been the independent emergence of TVS in India in the two-wheeler market.

Countering the criminal case

Countering the criminal case by Knorr Bremse and Securing the interests of Escorts Limited in the Railways business in India:

In 2016, SUO not only saved Escorts Limited from the criminal prosecution for the commission of IP theft of Breaking System designs of Knorr Bremse but also ensured a counter strategy that enabled Escorts get long-awaited approvals of it's designs from the Indian Railways other than securing the withdrawal of all criminal proceedings as against Escorts.

The consequence has been the breaking of decade long monopoly in the BMBS breaking technology in India which is approximately 30 thousand crore Rupee Business in India.

Strategy for exit

In 2016, we devised strategy for exit of M/s SIIL from Jaipur Ring Road Project, without the Company having to incur any liabilities.
